Your privacy matters to Captivated, LLC (“Captivated,” “we,” “us,” or “our”). This Privacy Policy explains how we collect, use, and disclose information that identifies you or can reasonably be used to identify you (“Personal Data”) in connection with your access to and use of our website and the Services we provide.

By accessing or using our Services, or by accepting our Terms & Conditions or any other agreement that references this Privacy Policy, you acknowledge that you have read and understand this Privacy Policy. If you do not agree, do not access or use the Services.

We may modify this Privacy Policy from time to time. When we make material changes, we will provide notice by posting an updated policy or through other reasonable means. Continued use of the Services constitutes acceptance of the updated policy.

2. Roles and Responsibilities

Captivated acts as a data controller with respect to Personal Data collected for its own business purposes, including sales, marketing, website operations, account administration, and customer support.

Captivated acts as a data processor with respect to Service Data processed on behalf of customers in connection with the Services. Customers remain the data controllers for Service Data and are responsible for determining how such data is collected, used, and disclosed.

3. Consumer Notice

If you communicate via text message, live chat, secure chat, or video chat with a business that uses the Captivated Services, your Personal Data is processed by Captivated on behalf of that business.

This Privacy Policy does not apply to Personal Data processed on behalf of Captivated customers. For questions regarding consumer data, please contact the business with whom you communicated directly. Data subject requests received by Captivated will be forwarded to the applicable customer.

4. Information We Collect

We collect Personal Data that you voluntarily provide to us, including your name, email address, job title, company name, billing address, telephone number, and payment-related identifiers.

We also collect Service Data entered into, transmitted through, or generated by the Services, including message content, metadata, usage statistics, configuration data, and performance metrics. Service Data is processed solely to provide and support the Services.

5. How We Use Information

We use Personal Data to operate our business, provide and support the Services, communicate with you, process transactions, respond to inquiries, and improve our offerings.

We do not sell Personal Data. We may use aggregated or de-identified data for analytics, reporting, service improvement, and business insights, provided such data does not reasonably identify you or any individual.

6. Communications and Security

Certain communications, including standard SMS messages, may not be transmitted with end-to-end encryption due to the nature of telecommunications networks.

Other features, such as Secure Chat and Video Chat, may provide additional security measures when configured and used appropriately. No communication channel can be guaranteed to be completely secure, and customers are responsible for selecting appropriate features for their use cases.

7. Payment Information

Payments for Services are processed through PCI-compliant third-party payment providers. Captivated does not store or directly process payment card or bank account information.

Payment providers process payment information in accordance with their own privacy policies and security practices.

8. Cookies, Analytics, and Tracking Technologies

We use cookies and similar technologies to operate the Services, understand usage patterns, improve performance, and support marketing efforts.

We use analytics tools, including Google Analytics, to collect information about how users interact with the Services. You may control cookies through your browser settings, though disabling cookies may affect functionality.

9. Third-Party Integrations

The Services may integrate with third-party platforms and services, such as Google or calendar providers. If you enable integrations, certain data may be shared with those providers subject to their privacy policies.

Captivated does not control third-party privacy practices, and you should review applicable third-party policies before enabling integrations.

Personal Data is retained in accordance with Captivated’s Data Retention Policy, which describes applicable retention periods and deletion practices.

Customers are responsible for exporting any data they require prior to termination of Services.

11. Data Preservation

Upon termination of Services, Captivated may, at its discretion, offer a temporary data preservation option prior to deletion. This option does not include active Services and is governed by Captivated’s policies.

12. Disclosures

We may disclose Personal Data to service providers who assist us in operating the Services, to regulators or legal authorities as required by law, to enforce our Terms & Conditions, or in connection with a merger, acquisition, or similar transaction.

13. Policy Hierarchy

If there is a conflict between this Privacy Policy and Captivated’s Terms & Conditions with respect to Service Data processed to provide the Services, the Terms & Conditions control.

14. International Use

The Services are intended for use in the United States. Personal Data may be processed and stored in the United States, where privacy laws may differ from those in other jurisdictions.

15. Your Rights

You may request access to or correction of your Personal Data by contacting us. Identity verification may be required to fulfill requests.

16. Children’s Privacy

The Services are not directed to individuals under the age of 18. Captivated does not knowingly collect Personal Data from children.

17. Updates to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated through reasonable means. Continued use of the Services constitutes acceptance of the updated policy.
